Terms and conditions & terms of use

These terms govern the use of the Wanderer app, of the associated website at wanderer-app.cc and of the separate web administration area through which mountain huts, regions and partner businesses are maintained. They set out what the app provides, which rules apply in dealings with one another, and who is answerable for what.

Which personal data is processed in the course of this, for what purpose and on which legal basis, is set out in the privacy policy. That policy forms part of the user relationship and is not repeated here; where it aids understanding, its sections are referenced.

The German version of these terms is the authoritative one; this translation is provided for convenience.

1. Contracting party and scope

The app is provided by Die schönsten Wanderwege, Karin & Erwin Neuherz (GesbR), Klam 87, 4352 Klam, Austria — referred to below as “we” or “us”. Full details including contact information are given in the legal notice.

The user relationship is formed between the individual and us as soon as an account is created. The version of these terms available at that time applies; for amendments, see section 24.

The editorial focus is on Austria. The app can be used from other countries as well; the information on trails, huts, regions and emergency numbers, however, relates to the areas covered.

Supplementary terms may apply to individual promotions — for example the conditions of entry for a giveaway. For that promotion, they take precedence over these terms.

2. What the app provides

The app maintains an editorially curated set of walks, mountain huts, regions and partner businesses, and builds the following features on top of it:

  • search and filters for walks, huts, regions and partner businesses, each with a map view and — once location access has been granted — your own position
  • huts along a walk, and walks leading to a particular hut
  • weather data for trails, huts and regions
  • saving trails and huts for your own reference
  • recording hikes with route, distance, duration, elevation gain, elevation profile and start and end times, plus your personal review in the hiking calendar and statistics
  • publishing posts including images, also as a hike report on a walk or a hut, along with comments and “like” responses
  • following other accounts, a personal feed and direct messages, in which images can be sent as well
  • challenges — evaluated from data, with a submitted photo, at a place or with a code — plus hiking points, badges and rewards from partner businesses
  • giveaways
  • “Hiker of the week” — a weekly contest for the post with the most likes (section 15a)
  • an emergency view with emergency numbers and your currently determined coordinates
  • notices about partner businesses and their offers, and a hiking quote of the day
  • individual items of app content that we highlight (section 16)
  • sharing content externally via a link on wanderer-app.cc (section 9a)
  • a newsletter by email, on request (section 22a)

The app is an aid to planning, recording and information. It replaces neither your own route planning nor your assessment of conditions on the ground (section 6), and it is not a rescue or emergency service (section 7).

On the further development of the feature set, see section 19.

3. Account and sign-in

Using the app requires an account; without signing in, only the loading screen and the sign-in screen are accessible. An account is created with an email address and a password, or via “Sign in with Google” or “Sign in with Apple”. A first name must be given on first launch; last name, self-description and profile picture are optional.

The details provided must be accurate. A self-chosen display name is permitted, as long as it does not misrepresent the identity of another person, business or organisation.

Credentials are to be kept confidential and not passed on to third parties. If you suspect unauthorised use, change your password and send us a message (section 22).

Each person may hold one account. Additional accounts intended to influence challenges, hiking points, “like” responses or giveaways, or to circumvent a suspension, are not permitted; they may be merged or deleted.

There is no entitlement to the creation of an account. We may refuse a registration where there is an objective reason to do so — for instance a previous permanent suspension.

4. Minimum age

An account may be created independently from the age of 16. Younger persons may use the app only with the consent of a parent or guardian, who then also accepts these terms. Where we become aware that an account exists contrary to this rule, it will be suspended or deleted.

5. Costs, and the relationship to the App Store and Google Play

The app is currently free to use. Costs arise only for the data connection, according to the tariff of the respective mobile provider.

Should we offer paid features in future, they will be identified as such before any purchase and agreed separately. Payment would in that case be handled through the App Store or Google Play; the terms of the respective store then apply in addition for payment, renewal, cancellation and refunds. Existing hiking points are unaffected by the introduction of paid features.

Apple and Google provide the means of obtaining the app but are not party to this user relationship. They provide neither maintenance nor support for the app and are not liable for its content. Claims in connection with the app — for instance under product liability, for the infringement of third-party rights, or under consumer protection law — are to be brought against us. Apple is entitled to enforce the provisions of this section as a third-party beneficiary; the same applies to Google.

6. Your own responsibility in the mountains

Information about trails — distance, walking time, elevation gain, difficulty, route, map and weather — is a planning aid and not an assurance about the state of a path. Conditions change at short notice: weather, snow cover, avalanche risk, rockfall, flooding, path closures, construction work or hunting activity.

Before setting off, the circumstances relevant to the walk are to be checked independently, in particular the forecast and any warnings, closures and conditions, your own physical fitness, equipment and provisions, as well as mobile coverage and the battery level of your device. Decisions about which route to take, what equipment to carry, where to turn around and when to abandon a walk rest with the individual.

Posts by other accounts are accounts of personal experience. They constitute neither a recommendation nor a safety assessment by us.

We ask that marked paths be used, that closures and nature conservation areas be respected, that wildlife not be disturbed and that no litter be left behind.

Alpine terrain carries risks that remain even with careful planning. Using the app does not remove your own duty of care.

7. Emergency view

The emergency view lists the emergency numbers for the region concerned and hands a selected call over to the phone function of the device. Where location access has been granted, it additionally displays the coordinates currently determined so that they can be passed to the control room. It also explains the alpine distress signal.

The view does not place an emergency call, does not alert any rescue organisation, and transmits neither location nor any other data to rescue services or to us. The emergency call must be made by the user, the location communicated by the user, and the instructions of the control room followed.

Whether a position can be determined, and how accurately, depends on satellite and mobile reception, the permissions granted, the device and local conditions. In woodland, gorges, caves, buildings or where reception is poor, considerable deviations can occur. We cannot assure that a connection exists at any given time, that a number can be reached, or that help arrives in time.

Feigning an emergency may have consequences under criminal and civil law.

8. Recording hikes

Recording requires that access to location has been granted in the operating system; this permission is managed on the device and can be withdrawn there at any time. Without it, recording, the location-based map view, parts of the challenges and the position display in the emergency view are unavailable or only partly available. A recording in progress continues while the app is in the background; details are set out in section 3.3 of the privacy policy.

A recording can be paused, resumed, discarded, or ended and saved. Saved recordings are initially visible only within your own account. Whether a hike is shared as a post is a separate decision (section 9); individual recordings can be deleted in the app.

If a hike is saved while there is no connection, it remains secured on the device and is uploaded as soon as a connection is available again. Until then it is marked in the app as not yet uploaded and can also be discarded there; it counts towards your personal statistics, challenges and hiking points only once it has been uploaded. A recording that could not be uploaded within 30 days is removed from the device.

If a recording in progress is interrupted because the operating system terminates the app or the app crashes, what has been recorded up to that point is preserved on the device and can be resumed or finished the next time the app starts. The time between the interruption and resuming is not recorded; the resulting gap in the route cannot be closed afterwards.

The values determined — position, altitude, distance, elevation gain, speed — depend on reception and device. No warranty is given as to their accuracy or completeness.

Any manipulation of a recording is prohibited, in particular through spoofed locations (GPS spoofing), emulators, modified devices or automated input. For the consequences, see section 13.

9. Visibility of your own content

An account is public by default. First name, last name and profile picture are then visible to other users, as are published posts, comments, “like” responses and the account’s connections.

An account can be set to “private” in the settings. Posts, activities and connections are then visible only to approved followers; follow requests can be accepted or declined, and existing followers removed. If a private account is set back to public, pending requests are treated as accepted.

There is no way to hide a profile entirely: first name and profile picture remain visible in search and in follower lists, even for a private account. Profile pictures are held in a publicly addressable storage area (section 3.2 of the privacy policy).

Individual accounts can be blocked. A block takes effect in both directions, hides the content of each side from the other and deletes existing follower connections; the blocked person is not notified. Blocks are managed under “Settings → Blocked profiles”.

Published content can be deleted. Copies or screenshots that others have made of it are beyond our influence.

9a. Sharing content externally

Posts, the hiking quote of the day, walks, mountain huts, regions and giveaways can be passed on using your device’s share function. What is passed on is a link on wanderer-app.cc. Anyone opening it who has the app installed lands directly in the app; everyone else sees a page on our website that displays the item and offers the app.

A shared link is public. Every person who receives it can view the item, without an account and without the app. Whoever shares therefore decides on the reach of that item — including when it was written by someone else.

For posts, a technical restriction applies: they are only displayed on the website if the account of the person who wrote them is public. Posts from private accounts, as well as hidden or deleted posts, are not displayed. If a post is deleted or the account is subsequently set to private, the content disappears from the page; a link that has already been passed on cannot be recalled, however, and copies that recipients have made are beyond our influence.

When sharing someone else’s post, their interests are to be respected. In particular, it is prohibited to place shared content in a misleading context outside the app, to present it as your own, or to use it for advertising purposes. The rules in section 11 apply to sharing just as they do to publishing.

We reserve the right to disable individual links where the content behind them breaches these terms.

10. Your content: rights and assurances

Anyone submitting posts, images, comments, profile details or messages remains the holder of the rights in them. We do not adopt this content as our own; it reflects the view or experience of the person concerned.

By submitting content you grant us the non-exclusive, royalty-free right to store it for the operation of the app, to process it technically — for instance in format and size for display — and to display it to the group of people provided for in each case. This includes display on a publicly accessible page at wanderer-app.cc once the content is shared, together with the preview required for that in the service the link was inserted into (section 9a). That right ends when the content or the account is deleted; for a limited period thereafter, the content may still be contained in backup copies and in third-party preview caches.

Any use beyond this — for instance in advertising, on the website or in posts on social networks — takes place only with separate consent.

By submitting content you confirm that you hold the necessary rights, that no third-party rights are infringed, that identifiable persons depicted have consented, and that the content is not unlawful.

Where claims are brought against us by third parties because submitted content infringes rights, the expense arising from this, including reasonable costs of legal defence, is to be reimbursed to us, insofar as the infringement was caused culpably. We notify the person concerned and give them an opportunity to comment.

11. Conduct in the community

The following rules apply to posts, images, comments, profile details and direct messages. Factual and respectful dealings are expected. The following are prohibited in particular:

  • insults, harassment, bullying, threats, hate speech and discrimination
  • glorification of violence, and extremist, pornographic or age-inappropriate content
  • content that infringes copyright, trade mark or personality rights
  • misleading or dangerous statements about paths, conditions or equipment
  • spam, chain messages and automatically generated bulk contributions
  • advertising and self-promotion without our consent, and the offering of goods and services outside the features provided for that purpose
  • links to external sites without a direct connection to the walk; references to car parks, timetables or official information pages are permitted
  • the publication of other people’s personal data without their consent
  • interference with technology and security: systematic extraction of data, automated access, circumvention of restrictions, or attacks on the infrastructure

The app is not a place for political or ideological disputes. Such contributions may be removed; no ongoing review of all content for this purpose takes place.

We do not read direct messages. Access occurs only for a specific reason, for instance following a report; details are set out in section 3.7 of the privacy policy. The rules of this section apply there just as they do in the public part of the app.

We are not obliged to review content before publication or to monitor it on an ongoing basis (section 16 of the Austrian E-Commerce Act, Art. 6 and 8 of Regulation (EU) 2022/2065 on digital services).

12. Reporting content, review and redress

Posts, comments, messages and profiles can be reported via the action menu of the content concerned. The available reasons are spam or advertising, harassment or bullying, hate speech or discrimination, violence or dangerous behaviour, sexual or offensive content, misinformation, copyright infringement, and other, along with an optional explanation.

Every report reaches our mailbox and is reviewed promptly, as a rule within 24 hours. The reported person is not told who submitted the report. Infringements of rights can equally be notified via the contact address given in the legal notice.

Where three people independently report the same post or comment, it is provisionally hidden automatically until the review has been completed. The author continues to see their own content. The final decision on removal is always taken by a person; no further automated decision-making about content or accounts takes place.

Where content is removed or hidden, or an account restricted, we notify the person concerned, state the reason and point out the option of having the decision reviewed. An objection can be submitted within six months of the notification to info@wanderer-app.cc; we review the decision again and reply with reasons. Recourse to the courts and to the competent authorities is unaffected.

Until the review has been completed, there is no entitlement to the immediate removal of reported content. Where the reporting function is plainly misused — for instance through a large number of unfounded reports — we may restrict it for the account concerned.

13. Measures in the event of breaches

Where these terms are breached, we may — depending on severity — issue a notice, remove individual content, restrict features, withdraw challenges or hiking points, suspend an account temporarily, or suspend it permanently and delete it. The choice depends on the nature, severity and repetition of the breach and on the harm caused.

In the case of serious breaches — in particular unlawful content, endangerment of others, manipulation of recordings, challenges or hiking points, and attacks on the infrastructure — measures may be taken without prior notice. Notification with reasons and the option of review follow section 12.

With a permanent suspension, any outstanding hiking points lapse. Rewards already redeemed are unaffected.

There is no entitlement to the restoration of a deleted account; deletion cannot be reversed technically.

14. Challenges, hiking points and rewards

Challenges run automatically for all accounts; no separate opt-in is required. There are four types:

  • challenges evaluated from data — based on the hikes recorded in the app or on your own posts, comments, reactions and follow connections
  • photo challenges — a submitted photo is reviewed by us and either confirmed or rejected
  • challenges requiring a place — completed by a recording that passes the target, or by confirming presence on site
  • challenges with a code — completed by redeeming a code available at the partner business or hut

Whether every activity is captured in full depends on reception, permissions and device; no warranty is given. Recordings whose average speed is well above what is attainable on foot do not count towards challenges.

For photo challenges we decide at our reasonable discretion whether the task has been completed; the guidance stated in the challenge is decisive. A rejection is given with reasons, and a further submission is possible. There is no entitlement to confirmation. Whether a submitted photo also becomes a post in the feed is decided by the person submitting it; such a post is unaffected by the review and can be deleted at any time by that person.

Codes apply once per account and period. Passing a code on is permitted; redeeming it repeatedly with the same account is not.

Hiking points arise from completed challenges. Any further occasions will be announced in the app. They are only credited once they are collected in the app; until then they form no part of the balance and cannot be redeemed. Challenges that have been completed but not collected do not expire — the points can still be collected after the challenge itself has ended. Hiking points have no monetary value, are tied to the account, are not transferable and are not paid out. A history of all credits and debits can be viewed in the app.

Where a badge is attached to a challenge, it is awarded together with the points. Badges are a distinction only and carry no value.

Rewards are redeemed with hiking points; the balance is reduced by the stated cost. How a reward is handed over is stated with it and depends on its type: voucher code — the code is assigned on redemption and is visible in the app straight away; show on site — the voucher sits in the app and is presented at the business named, any code comes from that business and is used up by tapping there; postal delivery — a delivery address must be provided and is stored for that delivery only; by arrangement — we get in touch to agree the details.

Redeemed rewards, including codes, can be viewed in the app under “My redemptions”. A voucher code is valid once; a voucher shown on site is valid until it is tapped and no longer thereafter. Repeated use is not permitted in either case.

Rewards may be limited in quantity and capped per account; both are stated with the reward concerned. Once a reward is sold out it cannot be redeemed until further notice. A reward may carry its own redemption terms — a period of validity or a particular location, for instance; these are stated with it and take precedence over this section.

Hiking points are not paid out in money, and a reward is exchanged neither for money nor for another reward. Reversal is not provided for in the app. If we cannot hand over a reward that has been redeemed, or where there has been an obvious mistake, we cancel the redemption and credit the hiking points back by way of a counter-entry; a message to support is enough.

Some rewards are provided by partner businesses. Where a service is supplied directly by a partner business, section 16 applies.

We may start, amend, extend, end early or discontinue challenges, and adjust the range of rewards and their cost. There is no entitlement to a particular challenge or reward or to its continued availability. If the point value of a running challenge is changed, the changed value applies to all completions not yet collected. Hiking points already credited are unaffected.

In the event of manipulation — such as fabricated recordings or photos not taken by the user and not taken for the task — we may delete recordings, reject submissions, withdraw challenges and revoke hiking points by way of a reversing entry (section 13).

15. Giveaways

Giveaways are voluntary promotions. The conditions of entry displayed with each giveaway apply — period, prize, determination of the winner; for entry, they take precedence over these terms.

Entry is made by signing up to the respective giveaway. Whether a comment has to be written is stated with the giveaway. An entry can be withdrawn until the end of the period; not afterwards, because by then it forms part of the draw.

The draw takes place after the entry period has ended and at random among all valid entries. It is recorded — with the time and the number of entries it was drawn from. Notification takes place in the app.

Payment of a cash equivalent or exchange of a prize is excluded. Where the person drawn does not come forward within the period announced, we may void the draw and draw again; that too is recorded.

In the event of manipulation or breaches of these terms, we may exclude an entry from the draw — before the draw and with a recorded reason. There is no entitlement to a giveaway being held; where there is an objective reason, we may amend, suspend or end a giveaway in progress.

15a. “Hiker of the week”

“Hiker of the week” is a contest decided not by chance but by the response of the community. It runs only for as long as it is shown in the app; there is no entitlement to it being held.

A calendar week is judged, from Monday 00:00 to Sunday 24:00 (Europe/Vienna time zone). Posts created during that week count; likes on them still count until 10 a.m. on the following Monday. There is no sign-up — writing a post is the entry.

One post per person is judged, namely the one with the most likes; where these are equal, the earlier one. The podium holds up to three places. How many likes a place needs at minimum, how many places receive a prize, and how long the pause after a win lasts is shown in the app; we may change it, and the change then applies from the current week onwards. Where no post reaches the minimum, the week closes without a winner.

Posts from accounts with a private profile, posts by our team and posts hidden following a report are not judged. Whoever wins is excluded from the judging for the number of weeks shown, so that the same accounts do not stay at the top permanently.

The result of a week is reviewed by us and recorded; place, name and the number of likes are stored unchanged at that point and do not change afterwards, even where likes are withdrawn or the post is deleted. Those placed are notified in the app. Whoever is on the podium is named there with their name, profile picture and post; that also applies to past weeks.

In the event of manipulation — in particular likes from accounts created for that purpose, or an agreed exchange of likes — we may exclude a post from the judging. This happens before the week is closed and with a recorded reason; passing over a place already recorded is not provided for. Section 13 applies in all other respects.

How many places receive a goodie is shown in the app. What the goodie is, we do not announce in advance — those placed find out when we get in touch with them. This is handled through a message in the app and an email to the address of the account; the details needed for despatch are to be provided to us in reply and are deleted once the matter is settled (section 3.8a of the privacy policy). Payment of a cash equivalent or exchange of a prize is excluded. No hiking points are awarded for a placing.

This contest is in no way connected to Apple or Google. Neither Apple nor Google sponsors it, administers it or is otherwise involved in it.

16. Partner content and advertising space

The app displays notices about partner businesses and their offers, for instance mountain huts, accommodation, restaurants, tourism boards, event organisers and cooperation partners. This content is delivered from our own servers; no third-party advertising networks are used, and there is no delivery based on personal interests. Paid placements are labelled as advertising.

In addition, we highlight individual items of app content — a walk, a region, a giveaway or a post, say — by displaying them in a prominent place. That selection is an editorial one; it is not a paid placement. Only content that is publicly visible in the app anyway is highlighted, and the notice leads to the item itself.

Information about services, prices, opening hours and availability comes in part from the businesses themselves. They are answerable for its accuracy and currency; we give no warranty in this respect.

Contracts for services of a partner business are formed exclusively between the individual and that business. We do not become a party to them, nor do we act as an intermediary.

17. Maintenance of huts, regions and partner businesses

Mountain huts, regions and partner businesses can be maintained by the businesses responsible for them. We invite the responsible person by email. Maintenance is carried out with an ordinary user account to which the respective entry is assigned; there is no separate type of account. The content itself is maintained not in the app but in the web administration area.

Anyone maintaining entries confirms that they are authorised to do so and keeps the information accurate and current. This includes amenities such as “accessible” or “dogs welcome”: they are a commitment to guests. Sections 10 and 11 apply to submitted content accordingly.

Posts serving solely to promote one’s own business do not belong in the community area; the business’s own entry and the partner spaces are provided for that.

The name, category and location assignment of an entry, and whether it appears in the app at all, cannot be changed by the business itself. We set those; a message to us is enough to have them changed.

An invitation and an assignment can be revoked. There is no entitlement to maintenance rights.

18. Rights in the app, and permitted use

The app, including its software, design, user interface, logos, trade marks, texts, images and its trail, hut and region data, is protected by copyright and trade mark law. The rights in it remain with us or with the respective rights holders.

You are granted the non-exclusive, non-transferable right to use the app on your own devices for private purposes. The following in particular are not permitted:

  • systematic extraction of content and redistribution of entire data sets
  • reproducing, adapting or publishing content outside the features provided
  • any commercial use without our prior consent
  • circumventing technical restrictions, and reverse engineering or decompiling the app, unless copyright law mandatorily permits it

Content of other users may not be used outside the app without their consent.

The map material is based on data from OpenStreetMap and is delivered via MapTiler. The attribution “© MapTiler © OpenStreetMap” in the map may not be removed or obscured; MapTiler’s licence terms expressly require it to be visible. For your own use of the map data, the terms of the Open Database License apply.

19. Availability, changes and further development

We endeavour to keep availability high. There is no entitlement to uninterrupted availability: maintenance, updates, technical faults, the failure of service providers used, official orders and force majeure can lead to restrictions. Where work can be planned, we announce it in the app as far as possible.

The app is developed further. Features may be added, changed or withdrawn, provided the purpose of the app is preserved and material rights of users are not unreasonably impaired. Substantial changes are announced beforehand in the app or by other suitable means. Proper operation may require updates to be installed; no warranty is given for older versions.

We cannot stand behind the permanent storage of content. Exporting your own recordings is not currently provided for in the app; a copy of your own data can be requested at any time via privacy@wanderer-app.cc.

20. Liability

We are liable for intent and gross negligence. Liability for slight negligence is excluded as far as legally permitted. Excepted from this are damage arising from injury to life, body or health, claims under the Austrian Product Liability Act, and other mandatory statutory grounds of liability.

As far as legally permitted, we are in particular not liable for decisions made in the terrain, for the accuracy of the location and recording values determined, for the completeness and currency of information on trails, huts, weather and partner businesses, for the content of other users, for failed mobile or internet connections, or for the reachability of emergency numbers.

For content submitted by users or partner businesses, we are liable under the provisions on hosting services only from the point at which we become aware of unlawfulness (section 16 of the Austrian E-Commerce Act, Art. 6 of Regulation (EU) 2022/2065).

The app carries no assurance of any particular sporting or health-related outcome.

Mandatory consumer rights remain unaffected in every case.

21. Data protection

Which data we process, for what purpose, on which legal basis and for how long, is set out in the privacy policy at wanderer-app.cc. It forms part of the user relationship.

Anyone publishing content that contains other people’s personal data — for instance identifiable persons depicted — must themselves ensure the data protection basis for doing so (section 10).

22. Contact and support

Enquiries are made via “Settings → Support & feedback” in the app — with the categories general, technical problem, feature request, billing and other — or by email to info@wanderer-app.cc. We reply as quickly as we can; no particular response time is promised.

Conversely, we may approach you on our own initiative where there is a matter concerning your account — a report, a reward redemption or a maintenance arrangement, for instance. This happens as a message in the app, which arrives in the chat with the team member responsible and can be answered there, or by email to the account’s address. These are not marketing emails; those are governed by section 22a.

Reports about content go through the reporting function (section 12), and data protection enquiries via privacy@wanderer-app.cc (section 21). Legal declarations are to be addressed to the address given in the legal notice.

22a. Newsletter

Anyone who consents receives a few emails a year with pointers to new trails, huts, regions and giveaways. Consent is requested when the account is created and can be changed at any time in the settings. It is voluntary: the app can be used in full without it, and without it no such email is sent.

Every one of these emails carries an unsubscribe link at its foot which works without signing in. After unsubscribing, no further mailing follows.

This does not affect emails that are part of using the app and are not advertising: confirmation of registration, password resets, replies to support requests and notices about changes to these terms. Those are sent regardless of consent to the newsletter.

There is no entitlement to a particular number of mailings or to particular content.

23. Ending the user relationship

The user relationship runs for an indefinite period and can be ended at any time without giving reasons: by deleting the account under “Settings → Account”, or by sending us a message.

Deletion ends access and removes hiking points, open challenges and giveaway entries. Which data is deleted in the process, and what is retained for what reason, is set out in section 7 of the privacy policy. The process cannot be reversed.

We may terminate the user relationship on four weeks’ notice. Where there is good cause — in particular serious or repeated breaches of these terms — with immediate effect; section 13 applies to this.

Content that other accounts have published in reference to deleted content is unaffected.

24. Changes to these terms

We may amend these terms with effect for the future where there is an objective reason to do so — a change in the law or in case law, official requirements, changed technical or security-related requirements, or changes to the app’s feature set.

Changes are announced at least four weeks before they take effect, in the app or by email, indicating the material points and the date on which they come into force. Anyone not agreeing to the new version may end the user relationship without disadvantage before that date.

Changes that shift the agreed scope of services or material rights and obligations to the disadvantage of users are not deemed accepted merely by continued use; for those we obtain express consent. Statutory consumer rights remain unaffected.

25. Applicable law, jurisdiction and dispute resolution

Austrian law applies. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the state of their habitual residence (Art. 6 of Regulation (EC) No 593/2008).

For consumers, the statutory place of jurisdiction remains available (section 14 of the Austrian Consumer Protection Act). Where the other party is an entrepreneur, a legal person under public law or a special fund under public law, the court with subject-matter jurisdiction at the seat of the business is agreed as the exclusive place of jurisdiction.

Complaints can be addressed at any time to the contact addresses given in the legal notice; we seek an amicable solution. We are not obliged to take part in proceedings before an alternative dispute resolution body and decide on this case by case. Consumers may additionally turn to the Austrian Internet Ombudsstelle (ombudsstelle.at).

26. Final provisions

Should a provision of these terms be or become invalid or unenforceable, the remaining provisions are unaffected. The statutory rule takes the place of the invalid provision.

Rights and obligations under the user relationship cannot be transferred without our consent; accounts are not transferable.

There are no side agreements. The German version of these terms is authoritative; the English version is provided for information.
